These Terms & Conditions (“Terms”) govern the provision of real estate photography and media services (“Services”) by Highland Real Estate Media (“we,” “us,” or “our”) to clients (“you” or “your”). By booking, purchasing, or using our Services, you agree to be bound by these Terms.

1. Services

We provide professional real estate media services, including photography, videography, drone imaging, floor plans, and related marketing content. The exact scope of work for each project will be confirmed in writing prior to commencement.

2. Booking & Scheduling

  • Bookings must be confirmed via email, phone, or through our online booking system.

  • The client is responsible for ensuring property access at the scheduled time.

  • Properties should be clean, staged, and photo-ready prior to the shoot.

  • If access is not available at the agreed time, additional fees may apply.

3. Payment Terms

  • All fees will be quoted in advance and are payable within [7 or 14] days of the invoice date unless otherwise agreed in writing.
  • We reserve the right to withhold delivery of final media until payment has been received in full.
  • Late payments may be subject to additional charges.

4. Cancellation & Rescheduling

  • Cancellations with less than 24 hours’ notice may incur a cancellation fee of $100
  • Rescheduling is subject to availability. Weather-related rescheduling (particularly for drone work) will not incur a penalty.

5. Usage Rights & Licensing

  • All images, videos, and media remain the intellectual property of Highland Real Estate Media.
  • A non-exclusive, non-transferable license is granted to the client for use of media in connection with the marketing and sale/lease of the specific property photographed.
  • Media may not be sold, transferred, or reused for other purposes without prior written permission.

6. Drone Operations

  • Drone photography is subject to weather conditions, flight restrictions, and compliance with Federal Aviation Authority (FAA) regulations.
  • We reserve the right to decline drone operations where safety or legal requirements cannot be met.

7. Client Responsibilities

  • The client is responsible for ensuring the property is ready and presentable at the time of the shoot.
  • We are not responsible for delays caused by unprepared properties or third parties.

8. Liability

  • While we take care to deliver professional results, we are not liable for indirect, incidental, or consequential losses arising from the use of our Services.
  • Our liability for any direct loss shall not exceed the total fee paid for the specific Services provided.
  • We carry public liability insurance in line with industry standards.

9. Image Storage & Archiving

  • Edited media will be delivered via digital download link.
  • We may retain copies for up to [6–12 months], but long-term storage is the client’s responsibility.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States and the State of Texas. Any disputes shall be subject to the exclusive jurisdiction of the courts.

11. Amendments

We reserve the right to update or amend these Terms at any time. The version in effect at the time of booking will apply.
